Terms of Use

1. Legally Binding Agreement

By accessing https://www.embedful.io (the “Site”) or using Embedful’s products, features, applications, and related services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”).

If you use the Services on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to both you and the entity you represent.

Embedful may update these Terms from time to time. The updated Terms will become effective when posted to the Site unless otherwise stated. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

2. The Services

Embedful provides a business-focused analytics and data visualization platform that enables users to connect data sources, create charts, tables, counters, widgets, dashboards, templates, and reports, and embed or share that content through websites, applications, and other digital properties.

Depending on your plan and the features available at the time, the Services may include:

• Charts, tables, counters, and other data visualizations
• Standard dashboards and customer-specific dashboards
• Multi-tenant dashboards and customer-specific widgets
• Embedded, public, private, and password-protected content
• Dashboard and widget templates
• Data refresh and scheduled data retrieval functionality
• Database connections, including supported PostgreSQL, MySQL, Firebase, and other data sources
• Google Sheets and other supported spreadsheet integrations
• CSV and Excel file data sources
• JSON data sources
• API and other third-party data integrations
• Google Analytics and other supported analytics integrations
• User and organization management features

Features, integrations, usage limits, and availability may vary depending on your subscription plan or promotional offer.

3. Account Registration

• You may need to create an account to access certain Services.
• You must provide accurate and current information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for activities conducted through your account.
• You must promptly notify Embedful of suspected unauthorized access or security incidents by contacting support@embedful.io.
• You may not create accounts for fraudulent, abusive, or deceptive purposes.
• You may not sell, transfer, or otherwise assign your account except where expressly permitted by Embedful.

If you invite additional users to an organization, you are responsible for ensuring that those users are authorized to access the organization’s account and data.

4. Free Plan and Free Accounts

Embedful may offer a free plan or free account with limited features and usage allowances. The Free Plan is intended for legitimate, reasonable use of the Services and does not guarantee unlimited or permanent access to any particular feature.

• Free accounts may be subject to usage, storage, data source, dashboard, widget, refresh, or other limits.
• Features and limits of the Free Plan may change from time to time.
• Embedful may limit, throttle, suspend, or terminate free accounts that engage in excessive usage, abuse, automated account creation, fraud, security attacks, or activity that materially impacts the Services or other users.
• Free accounts may be subject to inactivity or other account-management policies.
• Certain features may be available only to paid or promotional plans.
• Embedful does not guarantee that a particular feature will remain available on the Free Plan.

Nothing in this section limits any rights you may have under applicable consumer protection or other mandatory laws.

5. Subscription Plans

Embedful may offer recurring subscription plans with different features, usage limits, storage allowances, integrations, and other benefits. Current pricing and plan limits are described on the Site or within the Services.

• Recurring subscriptions are generally billed in advance according to the billing interval selected at purchase.
• Subscription prices may change in the future. Where required by law, we will provide appropriate notice of material changes.
• Upgrades, downgrades, and changes between plans are subject to the pricing, billing rules, and functionality available at the time of the change.
• Applicable taxes may be added based on your location and applicable law.
• Some plans or promotional offers may have additional terms disclosed at the time of purchase.

6. Lifetime Deals and Promotional Plans

Embedful may offer lifetime deals, lifetime licenses, or other promotional plans through Embedful or third-party deal platforms (“Lifetime Deals”).

Unless otherwise stated in the applicable offer, a Lifetime Deal provides continued access to the specific Embedful plan and features included in that offer for the lifetime of the applicable product or service, rather than for the lifetime of the purchaser.

• A Lifetime Deal is associated with the account that redeemed or purchased the offer and may not be resold, transferred, or assigned without Embedful’s written permission.
• The features, usage limits, number of users, dashboards, widgets, data sources, storage, and other allowances included with a Lifetime Deal are determined by the specific offer purchased.
• Lifetime Deal accounts may be subject to reasonable fair-use restrictions and technical limitations.
• A Lifetime Deal does not guarantee that every future Embedful feature will be included. New features may be introduced separately or may be restricted to certain plans.
• Embedful may modify, replace, or discontinue individual features where reasonably necessary for security, technical, legal, or operational reasons.
• If a Lifetime Deal is sold through a third-party platform, additional terms imposed by that platform may apply to the purchase, refund, or redemption of the deal.
• Lifetime access does not mean that Embedful is obligated to operate the Service indefinitely. If Embedful permanently discontinues the Service, the Lifetime Deal will also end.

Where a Lifetime Deal includes specific limits or benefits, those limits and benefits are determined by the terms displayed at the time of purchase or redemption. If there is a conflict between these Terms and the specific Lifetime Deal offer, the specific offer will govern only with respect to the Lifetime Deal benefits expressly described in that offer.

7. Payments and Billing

• Payments for paid subscriptions are generally due in advance.
• Recurring subscriptions automatically renew until canceled, unless otherwise stated at purchase.
• You are responsible for maintaining accurate billing and payment information.
• Embedful may use third-party payment processors to process payments.
• Embedful may suspend or restrict paid Services for failed payments, fraud, chargebacks, or other legitimate billing concerns.
• Taxes may be charged where required by applicable law.

8. Integrations and Data Sources

Embedful allows users to connect third-party data sources that they own or are authorized to access.

Supported data sources may include databases, spreadsheets, files, APIs, analytics platforms, and other third-party services. Examples include PostgreSQL, MySQL, Firebase, Google Sheets, Google Analytics, CSV files, Excel files, JSON data, and supported APIs.

• You are responsible for ensuring that you have the necessary rights and permissions to connect and process data through Embedful.
• You are responsible for the accuracy, legality, quality, and availability of data obtained from your connected sources.
• Embedful does not guarantee the availability, accuracy, completeness, or continued compatibility of third-party data sources.
• Third-party integrations may be modified, restricted, suspended, or discontinued by their providers at any time.
• Your use of third-party services is also subject to the applicable third party’s terms, policies, and privacy practices.

9. Database Connections and Credentials

Where Embedful supports direct database connections, you may provide connection information or credentials necessary for Embedful to retrieve data from the connected database.

You are responsible for ensuring that the credentials you provide are authorized for the intended use. Where practical, you should use credentials with the minimum permissions necessary for Embedful to perform the required operations.

You must not connect databases or provide credentials that you do not have authorization to access. You remain responsible for the data contained in connected databases and for configuring appropriate database permissions.

10. Customer Dashboards and Multi-Tenant Data

Embedful may allow customers to create dashboards and widgets intended for their own customers or end users. These may include customer-specific or multi-tenant dashboards where different users are shown different data based on configured customer, tenant, account, or other identifiers.

• You are responsible for configuring appropriate tenant identifiers, filters, permissions, and access controls.
• You are responsible for ensuring that one customer or tenant cannot improperly access another customer’s data.
• You are responsible for determining what information is appropriate to display to your customers or end users.
• Embedful provides technical functionality for customer-specific data presentation but does not determine which users should have access to your data.

11. Embedded, Public, Private, and Password-Protected Content

Embedful may allow charts, widgets, and dashboards to be embedded into websites, applications, or other digital properties.

Depending on your plan and configuration, content may be public, private, password-protected, or otherwise restricted.

You are responsible for configuring the appropriate access controls and for ensuring that you do not intentionally or unintentionally expose confidential, personal, proprietary, or otherwise restricted information through publicly accessible or embedded content.

12. Content

You retain ownership of data and content that you submit, upload, connect, or display through the Services, subject to the rights necessary for Embedful to provide the Services.

• You are responsible for all content and data submitted, uploaded, connected, processed, or shared through your account.
• You grant Embedful the limited rights necessary to host, process, transmit, retrieve, display, and otherwise use your content to provide and operate the Services.
• Embedful does not acquire ownership of your customer data merely because you use the Services to process or display that data.
• You must have all necessary rights, licenses, permissions, and lawful bases to use and process content through the Services.
• You must comply with applicable privacy, data protection, intellectual property, and other laws relating to your content.

You may not use the Services to upload, store, transmit, or distribute content that:

• Violates applicable law or regulation
• Infringes intellectual property, privacy, or other rights of another person
• Is fraudulent, deceptive, defamatory, or unlawfully abusive
• Contains malicious code or is intended to compromise systems or accounts
• Is intended to facilitate unauthorized access or other unlawful activity
• Contains highly sensitive information where its processing through Embedful is not appropriate or authorized

13. Intellectual Property

• Embedful and its licensors retain all rights in the Site, Services, software, interfaces, designs, trademarks, logos, documentation, and other materials provided by Embedful.
• Except as expressly permitted by Embedful, you may not copy, modify, distribute, reverse engineer, decompile, sell, sublicense, or create derivative works from the Services.
• You retain ownership of your data and content, subject to the rights granted to Embedful under these Terms.
